Terms of Use

The purpose of these Terms of Use (the "Terms") is to set out the conditions under which the LinQfolio platform (the "Platform") may be accessed and used. The Platform is operated by LINQFOLIO SAS, a French simplified joint-stock company (société par actions simplifiée) with share capital of €3,000, formed on January 6, 2026 by private deed, registered with the Paris Trade and Companies Register (RCS) under number 102 625 183, with its registered office at 142 rue de Rivoli, 75001 Paris.

In line with its corporate purpose, LINQFOLIO designs, develops, and operates digital solutions for connecting readers with one another and sharing cultural and literary content.

The LinQfolio Platform is a literary social network that lets you create a profile, post reviews, critiques, and lists, follow other readers, and interact with them.

Access to and use of the Platform are conditioned on full, unreserved acceptance of these Terms.

When creating an account, the User confirms having read the Terms and accepts them by checking the box provided for that purpose ("I accept the Terms of Use"). If the User does not agree, they must refrain from using the Platform.

Changes to the Terms

• LINQFOLIO reserves the right to amend the Terms to reflect legal, technical, or functional changes.
• Material changes will be announced with reasonable advance notice (email, in-app notification).
• Continued use of the Platform after a change takes effect constitutes acceptance of that change.

These Terms constitute an electronic contract within the meaning of article 1127-1 of the French Civil Code. Accepting the Terms electronically carries the same legal weight as a handwritten signature. By accepting the Terms, the User acknowledges that they are agreeing fully and unconditionally to all of their provisions, without exception or reservation.

3.1 Age and legal capacity

Use of the Platform is reserved for individuals aged at least 16. Where the law of the User's country of residence sets a higher minimum age, that higher age applies.

A person under 16 may not create an account. LINQFOLIO reserves the right to suspend and then close, after notifying the User, any account whose holder appears not to have reached this age, and to delete the associated data under the conditions set out in the Privacy Policy.

A User who becomes aware of an account on the Platform held by a person under 16 is encouraged to report it using the account-reporting feature provided for that purpose, or by writing to support@linqfolio.com.

3.2 Geographic availability

The Platform is available in France and the European Union. LINQFOLIO does not guarantee the availability, compliance, or support of the Platform outside these territories. Access from other countries is at the User's sole responsibility, and the User must comply with the local laws that apply.

3.3 Freemium model

Registration and the Platform's core features are free of charge. No paid transactions are available at launch.

LINQFOLIO reserves the right to introduce paid features or premium subscriptions in the future. Should this happen, Users will be informed beforehand by email or in-app notification, with reasonable notice before the change takes effect. Access to any paid feature will always require the User's explicit consent.

4.1 Registration

To use the Platform, the User must create an account by providing accurate, complete, and up-to-date information (a valid email address, a username, and a password). The User agrees to keep this information up to date. Information that is clearly false or misleading may result in the account being deleted.

4.2 Authentication

Registration can be completed by creating an account with an email address and password. LINQFOLIO may offer additional authentication methods in the future, such as signing in through third-party providers (OAuth / social sign-in, for example Google or Apple). Use of these methods will be subject to the terms of use of the relevant providers.

4.3 Account security

The User is solely responsible for keeping their login credentials confidential and for all activity carried out through their account. They must report any unauthorized access to support@linqfolio.com immediately. LINQFOLIO accepts no liability for the loss or takeover of an account resulting from the User's negligence.

4.4 Restriction and suspension

LinQfolio may refuse, suspend, or delete an account without notice in the event of a serious breach of the Terms, suspicious activity, or another legitimate reason (security, prolonged inactivity).

5.1 Permitted content

The User may post content related to the world of books and reading: reviews, critiques, ratings, book lists, comments, and photos of books or reading spaces.

5.2 Strictly prohibited uses

The User agrees not to post content that:

• violates applicable laws and regulations (incitement to hatred, violence, discrimination, or harassment, glorification of crime, etc.);
• infringes the rights of third parties (copyright, trademarks, right to one's image, privacy, defamation, insult);
• promotes or facilitates the counterfeiting or piracy of works (unauthorized distribution of substantial excerpts, sharing of pirated ebook files);
• amounts to spam or manipulative practices (fake reviews, fake accounts, bots, unauthorized commercial solicitation).

5.3 Moderation and reporting

LINQFOLIO may, without any general obligation to monitor content, remove any unlawful content that is reported, or suspend or delete an account in the event of a serious or repeated breach. Reports can be made using the dedicated button or by writing to support@linqfolio.com.

5.4 User responsibility

The User is solely responsible for the content they post on the Platform. The User indemnifies LINQFOLIO against any claim, action, or proceeding brought by a third party arising from the content they post. The User agrees to compensate LINQFOLIO for any loss suffered and to cover all costs, damages, and expenses, including attorneys' fees, arising from a breach of these Terms.

6.1 The User's rights

The User retains all of their rights in the content they create and post.

6.2 License granted to LINQFOLIO

By posting content, the User grants LINQFOLIO a non-exclusive, worldwide, royalty-free license to host, reproduce, display, adapt (for technical formats), index, and archive that content in order to operate the Platform for as long as it remains online. This license ends for each piece of content the User removes, or when the account is deleted, subject to statutory retention periods or the provisions of the Privacy Policy for content that has been anonymized or that is needed for LINQFOLIO's defense.

6.3 LINQFOLIO's property

The Platform and its trademarks, logos, algorithms, and editorial content are the exclusive property of LINQFOLIO. Any unauthorized reproduction or use is prohibited.

The processing of personal data is governed by the Privacy Policy available on the Platform, in compliance with Regulation (EU) 2016/679 of April 27, 2016 (GDPR) and French law no. 78-17 of January 6, 1978 on data processing, data files, and civil liberties ("Informatique et Libertés").

Under articles 15 to 22 of the GDPR, the User has the following rights over their personal data, which they can exercise by writing to dpo@linqfolio.com:

If you have difficulty exercising your rights, you may file a complaint with the CNIL (www.cnil.fr), the French data protection authority.

8.1 Services provided "as is"

The Platform is provided "as is" and "as available," with no guarantee that it will be free of errors or interruptions, or perfectly compatible with every device.

8.2 No liability for third-party content

As a hosting provider within the meaning of the French Digital Economy Act (LCEN), LINQFOLIO is not responsible for content posted by Users (inaccurate, offensive, or unlawful reviews). The User uses the Platform at their own risk.

8.3 Limitation of liability

LINQFOLIO can only be held liable for direct, certain, and foreseeable damages that are exclusively attributable to it. The following are excluded:

• indirect or non-material damages (loss of opportunity, loss of profits, loss of data, emotional distress);
• malfunctions caused by the User's improper use or by third-party equipment.

8.4 Force majeure

LINQFOLIO cannot be held liable for the total or partial failure to perform its obligations under these Terms where that failure results from a force majeure event within the meaning of article 1218 of the French Civil Code, including natural disaster, fire, telecommunications network failure, power outage, war, strike, pandemic, or any other circumstance beyond LINQFOLIO's control.

9.1 By the User

The User can close their account from the settings. Public content (anonymized reviews) may be retained for legal reasons.

9.2 By LINQFOLIO

LINQFOLIO may suspend or delete an account without notice in the event of a serious breach of the Terms or for legitimate reasons (security, inactivity exceeding 24 months).

9.3 Consequences

Once an account is deleted, access to the Platform is permanently closed. Data will be deleted according to the schedule described in the Privacy Policy (a 30-day period).

LINQFOLIO does not currently support external links to third-party services.

LINQFOLIO may modify, improve, or discontinue the services (maintenance, updates, new features) with reasonable advance notice.

Material changes will be announced by email, in-app notification, or a banner on the Platform, with reasonable notice before they take effect (ordinarily at least seven calendar days, except where a legal obligation or an urgent security measure requires a shorter period).

If you disagree with a major change that affects you, you can close your account before the change takes effect, using the options available in the app or by contacting support.

12.1 Governing law

These Terms are governed by French law. They are also subject to Regulation (EU) 2022/2065 of October 19, 2022 on a Single Market For Digital Services (the "Digital Services Act" or "DSA").

12.2 Competent courts

Any dispute will be submitted to the courts with jurisdiction over the Paris Court of Appeal, regardless of multiple defendants or third-party proceedings, except where exclusive jurisdiction or consumer-protection rules apply.

12.3 Mediation

Under articles L. 611-1 et seq. of the French Consumer Code, a consumer User may, after first attempting to resolve the matter with LINQFOLIO, refer the dispute free of charge to consumer mediation. The contact details of the designated consumer mediator, along with how to refer a dispute, are or will be published in the legal notice and kept up to date for as long as LINQFOLIO falls within the relevant scope of the French Consumer Code. In addition, a complaint may be filed on the European Union's online dispute resolution platform (ec.europa.eu/consumers/odr).

12.4 Attempt at amicable settlement

Before taking any legal action, the parties agree to attempt an amicable resolution by sending a written complaint to support@linqfolio.com.
